Terms & Conditions

1. Provider Identification

These Terms & Conditions govern the contractual relationship between you (the “Guest”) and the following entity (the “Provider”):

By making a reservation or using the services of Solar Alvura, the Guest confirms acceptance of these Terms & Conditions in full.

2. Scope of Services

Solar Alvura is a wellness retreat offering accommodation, wellness programmes, spa treatments, and related hospitality services. The services provided are exclusively for wellness, relaxation, and lifestyle purposes and do not constitute medical treatment, diagnosis, or healthcare within the meaning of Portuguese or EU health legislation.

Guests acknowledge that wellness activities (including but not limited to yoga, meditation, fitness, spa therapies, and nutritional guidance) are undertaken voluntarily and at the Guest’s own risk. Guests with pre-existing medical conditions should consult their physician before participating.

3. Reservations & Booking

3.1 Rate Types

Solar Alvura offers the following rate types:

Flexible Rate (14-day cancellation)

  • Cancellations or modifications may be made free of charge up to 14 days prior to the scheduled arrival date.
  • Full payment of the reservation is due 14 days prior to the arrival date.
  • Cancellations made within the 14-day period prior to arrival are non-refundable; 100% of the reservation total will be charged.

Non-Refundable Rate (10% discount)

  • The Non-Refundable Rate is offered at a 10% discount compared to the Flexible Rate.
  • Upon booking, the Guest will be charged the full reservation amount immediately.
  • No refunds, cancellations, or date modifications are permitted under this rate.

3.2 Provisional Reservations

Reservations made by email or telephone are treated as provisional (tentative) and are subject to the following conditions:

  • The selected room or accommodation will be held for a maximum of 48 hours from the time of the provisional reservation.
  • The provisional reservation is confirmed only upon receipt of the applicable payment and/or acceptance of these Terms & Conditions within the 48-hour window.
  • If payment or acceptance is not received within 48 hours, the provisional reservation will be automatically released without further notice.
  • Provisional reservations apply to both Flexible and Non-Refundable rate types.

3.3 Confirmation

A reservation is considered confirmed only when the Guest has received a written confirmation (by email) from Solar Alvura, payment has been processed in accordance with the applicable rate, and the Guest has accepted these Terms & Conditions.

4. Cancellation & Refund Policy

The following cancellation rules apply depending on the rate type selected:

All cancellation requests must be submitted in writing by email to reservations@solaralvura.com. The cancellation date is the date on which Solar Alvura acknowledges receipt of the request.

Solar Alvura reserves the right, at its sole discretion, to offer a credit voucher for a future stay in lieu of a refund. Such vouchers are valid for 12 months from the date of issue, are non-transferable, and carry no cash value.

5. Modification of Reservations

Date changes are subject to availability and the applicable rate conditions:

  • Flexible Rate: date modifications are permitted free of charge if requested more than 14 days before the original arrival date.
  • Non-Refundable Rate: no modifications of any kind are permitted.

Any modification resulting in a higher total price will require the Guest to pay the difference. Modifications resulting in a lower price will not generate a refund of the difference.

6. Children Policy

Solar Alvura operates as an adult-oriented wellness retreat. The following policy applies to minors:

  • Children under the age of 7 years are not accepted.
  • Children aged 7 years and above are welcome; the full adult rate applies.
  • Cots, cribs, and extra beds are not available.
  • Parents and legal guardians are responsible for the supervision of children at all times. Solar Alvura does not provide childcare services.

7. Check-In & Check-Out

  • Check-in: from 15:00 on the day of arrival.
  • Check-out: by 11:00 on the day of departure.

Early check-in or late check-out may be available upon request and is subject to availability. An additional charge may apply. Failure to check out by the stated time may result in an additional night’s charge.

8. Guest Conduct

Guests are expected to behave in a manner consistent with a peaceful wellness environment. Solar Alvura reserves the right to terminate a Guest’s stay without refund if the Guest:

  • Engages in behaviour that is disruptive, offensive, or threatening to other guests or staff.
  • Causes damage to the property, furnishings, or grounds.
  • Violates Portuguese law or engages in any illegal activity on the premises.
  • Fails to comply with reasonable house rules communicated at check-in.

9. Liability & Health Disclaimer

Solar Alvura is not a medical facility. None of the wellness services, treatments, or programmes offered constitute medical advice, diagnosis, or treatment. Guests participate in all wellness activities at their own risk.

Solar Alvura shall not be liable for any loss, injury, or damage to the Guest or the Guest’s property, except where caused by proven negligence or wilful misconduct on the part of Solar Alvura or its employees.

Guests with medical conditions, allergies, pregnancy, or any health concern that may be affected by wellness treatments must inform Solar Alvura in writing prior to arrival and before participating in any activity.

10. Force Majeure

Solar Alvura shall not be liable for failure to perform any obligation under these Terms if such failure results from circumstances beyond its reasonable control, including but not limited to: natural disasters, pandemics or epidemics, government orders or travel restrictions, armed conflict, strikes, fire, flood, or severe weather events.

In the event of force majeure, Solar Alvura will use reasonable efforts to offer the Guest an alternative date or a credit voucher for a future stay. No cash refund obligation arises from force majeure events.

11. Privacy & Data Protection

Ectiva Health, Lda. processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”), the Portuguese Lei n.º 58/2019, and any other applicable data protection legislation.

Personal data collected during the reservation and stay (name, contact details, payment information, health disclosures) is processed for the following purposes:

  • Performance of the accommodation and service contract.
  • Compliance with legal obligations (including Portuguese tax and accounting requirements and guest registration obligations).
  • Legitimate interest in improving services and communicating with guests.

Guests have the right to access, rectify, erase, restrict processing, and port their personal data by writing to reservations@solaralvura.com. Guests also have the right to lodge a complaint with the Portuguese supervisory authority (Comissão Nacional de Proteção de Dados, CNPD).

12. Intellectual Property

All content, branding, images, logos, and materials related to Solar Alvura are the property of Ectiva Health, Lda. and are protected under Portuguese and EU intellectual property law. Reproduction, distribution, or commercial use without prior written consent is prohibited.

13. Complaints & Dispute Resolution

Guests may submit complaints in writing to reservations@solaralvura.com. Solar Alvura aims to respond to all formal complaints within 15 business days.

In the event of a dispute that cannot be resolved amicably, the parties may seek resolution through the Consumer Dispute Resolution Centre (Centro de Arbitragem de Conflitos de Consumo) of the Algarve region, in accordance with Portuguese consumer protection law (Lei n.º 144/2015).

14. Applicable Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the Portuguese Republic. Any dispute arising from or in connection with these Terms shall be submitted to the competent courts of the Algarve judicial district, Portugal, without prejudice to the Guest’s mandatory consumer rights under EU Directive 2011/83/EU or the Guest’s country of residence.

15. Amendments

Solar Alvura reserves the right to amend these Terms & Conditions at any time. The version in effect at the time of the Guest’s reservation shall apply to that reservation. Material changes will be communicated via the Solar Alvura website and, where possible, by email to guests with existing reservations.
